      1.1 The following sets out the Terms and Conditions for Summit Better Crypto Limited, trading as Koda Finance (“Koda”), a company registered in the United Kingdom under registration number 13406644 and registered address of Lower Andrews House, 61 Wallingford Road, Uxbridge, London, England, UB8 2RW.
      1.2 These Terms and Conditions apply in whole, or in part, to all individuals and entities who use, interact with or simply visit our Site (https://koda.finance/). By visiting and/or interacting with our Site, you agree to the applicability of these Terms and Conditions.
      1.3 Please note that these Terms and Conditions are governed, and construed in accordance with, the law of England and Wales. If you are accessing this Site from outside of the United Kingdom you, as a user of this Site, are solely responsible for complying with all local laws and regulations.

      2. Age restrictions:

      2.1 Due to the nature of this Site, we ask that you do not visit, interact with or use this Site unless you are above the age of 18 years.

      3. Description – What is Koda Finance all about?

      3.1 Koda is the name behind a new up and coming community driven cryptocurrency. The Koda Token is a trusted advanced cryptocurrency which has been created and developed by the Summit Better Crypto Limited development team. The idea behind the Koda Token is to help those who find cryptocurrency and blockchain complicated understand what cryptocurrency is about because after all, we believe that cryptocurrency is and will be currency of the future.
      3.2 Our overall aim is to make cryptocurrency accessible to everyone with a community build to help each other. We are currently working on a decentralised swap, similar to pancake swap, focusing on Bep-20 coins. We hope that this will restore faith back into token trading after the recent events that have taken place in the cryptocurrency market, with our main aim being to appeal to the masses by simplifying cryptocurrency trading and protecting individuals like yourself against extortion and fraud.

      3.4 Our Site, at present, is mainly a place for educational resources. Under no circumstance is the content on our Site financial advice. Please remember this when visiting our Site, as well as watching any of our videos or reading any of our content.

      4. How to buy Koda Token’s:

      4.1 In order to buy Koda Token’s, you will need 3 apps: 1) Trust Wallet; 2) Telegram; and 3) Binance. Once you have downloaded these 3 apps the process is pretty simple once you get the hang of it. However, we do recommend that you watch our YouTube Video “How To Buy Koda V2” which will walk you through the full process. If after watching the video you still have any questions, please feel free to ask for help in the Telegram app or get in contact with us directly by sending an email to info@koda.finance.

      5. How to sell/exchange Koda?

      5.1 Currently, Koda does not have an exchange platform however, as mentioned above in section 3.3, Koda are currently working on a decentralised swap system.
      5.2 At present, in order to sell your Koda Tokens they must be changed into a different currency. This currency is US Dollar Tokens (“USDT“). You must then take this onto another platform as take the money out as you wish.
      5.3 Currently, you cannot buy anything with Koda Tokens. You can only buy and sell the tokens.

      6. Other educational resources:

      6.1 The Koda Site offers a range of educational resource surrounding Koda Tokens and cryptocurrency in general, including the Koda lite paper, the Koda Investment Pack and several YouTube videos.
      6.2 In addition to this, we are hosting Cryptocurrency Educating Sessions which are targeted towards those who are wanting to join our community and buy Koda Tokens but simply don’t know where to start. These sessions will be hosted online and in person at our head office.
      6.3 These sessions can be booked via our Site or by sending an email to info@koda.finance.

      7. Value of Koda Tokens:

      7.1 The value of Koda Tokens is determined by standard market forces. Koda themselves do not have any involvement in setting the value of the tokens.

      8. Wallet:

      8.1 Currently, Koda do not have an official wallet. For this reason, we recommend that you use a trusted and well-established wallet such as Trust Wallet or MetaMask.
      8.2 Please note that although Koda may recommending the use of these wallets, we are not associated with either company. We cannot be found responsible for any issues caused by the wallets we have recommended.

      9. Prize competitions:

      9.1 Koda, from time to time, offers a range of prize competitions in which Koda holders and members of the public can enter in order to win a range of prizes.

      10. Referral scheme:

      10.1 Description:
      10.1.1 This Referral Scheme aims to provide our medium to long-term Koda Token and KAPEX holders with an incentive for staying with us and recommending these tokens to others.
      10.1.2 In order to take advantage of such Scheme you must be a holder of either Koda Tokens or KAPEX and must have access to a link which is provided by the Koda team. These links can then be shared with family, friends or anyone else who you think may be interested in purchasing these tokens. If the individual who the link has been shared with decided to purchase any of the tokens, subject to the below Terms, you will then be rewarded by receiving a small percentage of the value of those tokens. This incentive payment will be placed directly into your personal wallet.
      10.1.3 This Scheme is in no way a commission payment scheme or payment of service. It is simply a benefit paid to the holder as an incentive to recommend our services to others.
      10.1.4 Please note that this scheme can be discontinued or modified at any point at Koda’s discretion.
      10.2 Variation of benefit:
      10.2.1 Depending on a number of factors, the percentage you receive when someone purchases either Koda or KAPEX Tokens using the link you have provided may change.
      10.2.2 The standard percentage holders will receive is 1% of the cryptocurrency purchased. This may increase to 3% for a short period of time in order to reward our holders however, this is decided at the company’s discretion.
      10.2.3 The percentage you receive may change at any time. For more information about what the specific percentage attached to your link please contact our Koda team via email.
      10.2.4 Please note that the percentage referenced above is of the cryptocurrency purchased and not the value of the cryptocurrency purchased.
      10.3 How to get your link:
      10.3.1 In order to start receiving benefits, you must have access to your own unique link which is provided by Koda. This link can be found on either our website or by getting in touch with the Koda team via email.

      10.4 How you will receive your incentive payment:

      10.4.1 All incentive payments will be paid in the respective token the individual has purchased.
      10.4.2 There will be no cash alternative available for this scheme. All rewards will be paid in either Koda Tokens or KAPEX.
      10.5 Conditions on receiving payment:
      10.5.1 In order for you, as a Koda Token or KAPEX holder, to receive an incentive payment for the tokens that have been purchased by an individual using your link, the individual must retain the Koda Tokens or KAPEX for at least 3-months. This means that if the individual sells or trades these tokens within this 3 month period, you as the distributor of that link will not receive any incentive payment.
      10.5.2 If the individual retains the purchased tokens throughout this 3 month period, all relevant incentive payments will be paid directly into your personal wallet within 30 days of the end of this 3 month period.

      12. Legal and regulatory compliance:

      12.1 Legal and regulatory framework around cryptocurrency is ever changing and updating. Whilst we acknowledge this, we strive to maintain full compliance with all of our legal and regulatory requirements.

      13. Intellectual property:

      13.1 With the exception of content a user may add to this Site, all content included on this Site, including copyright or trademark material, or other intellectual property, belongs to, or is licensed by Koda. Such content is protected by intellectual property laws and regulations and may not be copied, reproduced or used in any way without the express permission of Koda.

      14. Indemnity:

      14.1 As a user of this Site, you shall defend, indemnify and hold harmless Koda against claims, actions or proceedings for losses, damages, expenses and costs (including court courts and reasonable legal fees) arising out of or in connection with your use of this Site and/or our services.

      15. Limitation of liability:

      15.1 Koda strives to create and provide a safe environment for its users. However, we accept no liability for any damages that may be caused to a user either directly or indirectly through the use of this Site. Any liable Koda does have to any user is limited to [insert amount].
      15.2 Nothing in these Terms seek to exclude or limit Koda’s liability for death or personal injury caused by negligence (including negligent actions taken by employees, agents or sub-contractors), or for fraud or fraudulent misrepresentation by Koda. Nor does it limit any liabilities otherwise required by law.

      16.1 Koda are not professionals nor are we regulated by the Financial Conduct Authority (“FCA”) and therefore do not and will not provide any financial advice to any visitors of this Site, or to any of our users.
